Terms of Service

These terms govern your use of Text-Back-in-60, an SMS missed-call recovery and booking service operated by Christopher Haigh (sole trader, Australia) trading as Text-Back-in-60. By purchasing or using the service you agree to these terms.

1. The service

Text-Back-in-60 catches calls you don't answer on your published business number, sends the caller an SMS within 60 seconds, qualifies the job by SMS, offers booking times against your Google Calendar, and creates a calendar event for the booking. It is a productised service: setup is performed personally by us, and ongoing operation runs on Twilio, Make.com, Anthropic, and Google infrastructure.

2. Eligibility

The service is offered to Australian businesses operating with a valid ABN. You confirm that you are authorised to enter into this agreement on behalf of your business and that the contact and forwarding information you provide is accurate.

3. Pricing and billing

3.1 Founding offer (first 10 customers)

Founding pricing is locked for the lifetime of the founding customer's continuous subscription.

3.3 Billing

The setup fee is charged at purchase. Monthly subscription fees are charged in advance, beginning on the day your service goes live (after we have completed the joint setup test together). All payments are processed by Stripe.

4. Cancellation and refunds

You can cancel your subscription at any time by emailing chris@textbackin60.com.au. There is no minimum term. Cancellation takes effect at the end of your current billing period; we do not pro-rate partial months.

The setup fee is covered by our refund policy — if Text-Back-in-60 does not generate at least 3 qualified booked jobs in your first 30 days of going live, we refund your A$197 setup fee in full.

We work hard to keep the service running, but we depend on third-party providers (Twilio, Make.com, Anthropic, Google) and we cannot guarantee 100% uptime. The service is offered on a "best effort" basis. We will notify customers of any extended outage and work to restore service quickly.

8. Limitation of liability

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that:

9. Termination

Either party may terminate this agreement on 30 days' notice. We may terminate immediately if you breach these terms materially and do not remedy the breach within 14 days of being notified. On termination we will deactivate your dedicated phone number, revoke calendar access, and delete active conversation records within 30 days.

10. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these terms.

11. Changes to these terms

We may update these terms from time to time. We will notify customers of material changes by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
